View Full Version : Got a court summons in the mail!

Okay, as some of you know myself and a few other CLSBer's got speeding tickets a couple weeks ago on a ride. The officer told me that I'd just have to pay my $75 within 15 days and I'd get my license back. I'd go on supervision for 90 days, and I was a good boy I the ticket wouldn't go on my record. BTW, it was a 45 in a 30 ticket.

I mailed in my check the next day, and it was cashed on the 8th. Today I get a summons to appear in court. WTF? I haven't had a ticket in 6 years, and the last one was in Tennessee for doing 42 in a 35 in my car. I did traffic school and it was wiped.

Have any of my other ticketees received a summons? What can I expect. Help please.

Check to see if they cashed your check. I've had them lose things like that before. You have to then call the P.D. and straighten it out.

Something similar to this happened to my wife. After paying she got a notice to appear. She called the clerk of the court and after the clerk did some investigating, she was told it was an error and to ignore the notice. Her licence came in the mail the week after.


Call the clerk!!!

I agree with Jynx. I don't think you have a lot to worry about. You should call the clerk or even stop by and just get it cleared...
You're just gonna have to take it easy for the next 3 months though...

:doh Nope, my bad, my bad. This summons is for the incident with the water-filled balloon, tub of Vasoline, and the Garden Hose over at Discovery Zone. :thumbsup

Oops, my bad again. Gosh, I'm such a dummy, lol this summons is for that time is was screwing the peanut butter jar with the blinds up. :thumbsup

Chris,

The $75.00 is the bond for the speeding ticket, you get a court date, which they gave to you. Now you go to court and plead before the judge. If you plead guilty, the judge then decides your sentence, which can be a number of things. 1) He gives you supervision, which means your guilty but the conviction is not on records if you get pulled over again, it does mean your insurance company can find out about it if they want to. 2) He doesn't give you supervision, finds you guilty, forces you take the traffic school class, which is additional cost. 3) Finds you guilty and suspends your license, orders you pay to pay additional fines. If you don't see the cop who wrote the ticket in court, plead not guilty, the ticket will be dismissed, but I guarentee the cop will be ther.

What we were told by the cops and what the ticket info said is -- if we mailed in the ticket with the fine within 14 days of the issuance date, we would qualify for Court Supervision through the Mail option. We all mailed in our fines and followed the directions on the ticket info, checking the Court Supervision Through the Mail option. Supposedly, if you do this they do not mail out a court date. That is why we are confused. Has anyone called on this? I'll try at lunch time. :thumbsup

Call the clerk's office... they will tell you what's going on. Most likely what happened was the system that generates the court dates is a different system than the one that keeps track of payment. They probably received your payment, but the other system spit out a court date for you. If that's the case, no big deal. Just call the County Clerk's office, (in DuPage I think it's Joel Keagan or something like that) - don't ask. They will be able to help you out.

Chris, as I told ya. They cashed your check on the same day as the summon was sent out. I'll bet if you call them, they will tell ya to dismiss the court summon.

Rick - dude, that might be how things work in Canada :laughing but if you get a ticket with MUST SHOW IN COURT, ya don't send in any money before hand.

Learn from my mistakes. Never listen to a cop regarding a ticket, never. Take the ticket, and read all the fine print. Investigate your plea options.

If you are still confused, go to the Clerk of the Courts website. Cook, Will, and Lake County's have an excellent FAQ regarding Traffic Tickets.

I speak from experience. I had two police officers, a Vernon Hills officer, and a Brookfield police officer lie to me regarding my options. Not distort, not beat around the bush. Lie to me.

I realize that not all cops are like this, but you have to be aware of your rights and the ways to mediate the violations. These people are law enforcement officers, not officers or clerks of the court.

Yeah, he pulled us all over at once. We all got one 45 in a 30 speeding ticket. We thought about fighting the tickets, but figured we had a lot to lose if things didn't go well. Reckless Driving, speeding 30+ over, improper lanes usage, etc. We broke the law, we suffer the consequences. :thumbsup

Hey WSE, you forgot to mention that there were like 4 squads that showed up from multiple directions within seconds of us all pulling over. 3 others drove by while we were patiently waiting for our lecture to finish and them to commence the ticket writing. Basically, if we would have tried anything we would have been totally screwed.

BTW, no court summons yet for me or Nolan. We'll be checking the mail frequently for the next few days!:rolleyes

heh, I was wondering how you all managed to get pulled over at once. If you all got a lawyer, you could get out of it easy 'nuff... but from the sounds of it, this might be one that you're better off just paying.

I received this info from a friend of mine, who used this site numerous times after getting speeding tickets, including misdeminor reckless driving, he never had an attorney and managed to get out of tickets or get the charges replaced with much smaller offense every single time. Check this out:

Yeah, I think BWA is right. I checked my ticket and it says if I pay before 15 days then I won't have to show up in court. I checked my bank and the check was paid out in the 8th, so they must have put it through at least 3 days prior. Its probably just a paperwork error. I'm gonna call them once these corporate tours leave my office.

Just got off the phone with the County Clerk. There is a long lag time between processing the payment and sending out court dates. So their computer automatically sent out a summons even though my payment was processed.

My summons had been cancelled and supervision granted.

Other ticketees, you're probably in the same boat. If you got a summons I suggest you still call and make sure you don't have to appear.
