Visor ticket

So I got my first ticket on the bike

Yesterday the weather was awesome, so I went for a ride after work, I'm in stop and go traffic on york road, downtown elmhurst, not even making it past 10mph, on the way through I made eye contact with a police officer in one of those dark gray cars.. I think nothing of it and keep on, 4 cars ahead of me, who knows how many behind me.. kind of the same deal on the opposite side...
so I'm just sitting stopped waiting for the light to turn and I hear the siren horn, I turn around, there's the officer at an angle in the other lane, it took me a sec to figure out he had a problem with me, so I pulled into a parking lot, took off the gloves and helmet and waited for him.

He introduced himself as Elmhurst police and told me he was going to give me a citation for not having my visor down. Personally I felt like I deserved a warning, we were doing less then 10mph and I was in full gear (so not like I don't care about my safety).

so first I'm going to find some sunglasses to wear with my helmet, because I can just see myself getting more tickets, I like flipping up the visor at the lights.
this is a moving violation.. so I'll get 5 points on my license, should I get a lawyer? or just contact the DA/judge/whoever and try to work something out (this is DuPage).. or just show up in court and hope they take pity on me.

Edit: due to some speeding tickets in the car last year (one in april, one in aug) i don't think i'm elligable for traffic school or supervision.

You'll get supervision. I'm not sure how the tickets work now as far as sending in and taking a bs class.

I'm fine with the BS class, I've taken it 2 years ago (i think) it was sorta good to repeat certain things... i'm even fine with paying the $75 (or more in case of lawyer) I just don't want the points.

my visor was all the way up guess i'll keep that in mind, to only open it a couple notches, that's a good excuse lol
I have had it open all the way to "defog" before.

I would fight it. He won't have pictures. I would say he was mistaken or caught you at a moment where you raised it because it was fogging up. I would point out the amount of gear you wear and that you are safety conscious.

Btw, did you ask him for a written warning?

That's a bullshit revenue generating ticket if I've ever seen one. So the guy with a tank top and no helmet won't ever get ticketed for no safety gear but the guy with the visor slightly up on his helmet does. Sounds to me like homeboy was power trippin'. Wait til Black Jesus hears about this...

I didn't ask, he'd already decided to give me a ticket before he even got out of the car ... I'll never make eye contact with officers again lol...

I did tell him it was stuffy while i was stopped in traffic, but nothing else, so I think nothing will come to bite me in the ass in court .. assuming he shows up at all.

I was thinking the same thing.. just show that I was being completely responsible in every way and just defogging.

ps. does it really work to keep rescheduling the court date?

I'd take this as a lesson on why you don't ever want to socialize with officers no matter if that's making eye contact or getting married to one. The rules for them are different than they are for "normal folk". This is a BS ticket that any understanding level headed person would not have written especially considering that you were riding with more gear on than 90% of the people out there so you clearly don't take safety lightly as most do.

Personally I would send in the fine for supervision and take the class. If you go to court and lose it will cost more in fines and court cost plus your time away from work. No lawyer will be needed tho. Another waste.

I wonder what that height is, that'd be a good one! gonna go look it up.. I think my windscreen is slightly bigger then the average sportbike.. would be comical if it was just barely enough, not that I'd start riding with my visor up, I don't even like riding that way.

"Transparent shield" means a windshield attached to the front of a motorcycle that extends above the eyes when an operator is seated in the normal, upright riding position, made of shatter‑resistant material, or a shatter‑resistant protective face shield that covers the wearer's eyes and face at least to a point approximately to the tip of the nose.
(c) Contact lenses are not acceptable eye protection devices.

Bullshit reason for a ticket, but technically it's legit. I do the same thing all the time, flipping up the visor at and leaving red lights. You cought a ticket hungry suburban cop in those few seconds of ridin' dirty, but an easy ticket to get dropped with a decent lawyer.

As long as you are not moving.... It's all good. Drop the visor to the tip of your nose (covering the eyes) and you're all good. Being someone who has taken gravel to the eyeball and had it caught in the eyelid, it's a good thing. I had sunglasses (wrap-around) and still took a hit. The cop was only doing his job. Not a bullshit reason at all.

Ride smart... stupid hurts.

If I were getting a ticket on a bike I would ask if I could sit in their car while the ticket was being written (cool down with the a/c as an excuse). Then fart non stop in the car. Yep, it's a bs ticket, but it's the law.
