Texting while driving tix

the fiancé got one yest at 610 pm...cop said she was texting. it is a $147 dollar tix, plus traffic school. or we can contest it. if we contest it and lose, i know we have to pay court fees, on top of the tix...but does she still have the option to do traffic school? or does it automatically mean guilt admission and now, goes on her permanent record?

i am on the fence with what to do. she was NOT texting and we can pull her online usage up, which kind of proves it...but the window gap is small. the tix was written at 610p and her last message received/sent was at 542pm.

should we fight it? my cop buddy is on vacation so i have no insider info!

happened in Schaumburg...golf and meacham

Traffic school requires you to plead guilty. That sucks, Ill be sure to give her a hard time next time I see her. So what was she doing with her phone for the popo to pull her over? I think that window might be big enough, but I have never had to fight for texting while driving.

ya you better! haha. i was pretty pissed. i had to pause the ps3 for like an hour!

she said she was plugging her phone charger in and he saw her with the phone in her hand and asusmed she must have been texting. she probably could have gotten out of it but she said she was acting like a bitch!

If 28 minutes isn't enough of a window then we are doing something wrong as a society. I often text my wife just as I'm leaving to let her know what I'm doing. Then, two minutes later I'm in the car and on my way. 28 minutes is a world different than that.

However, be cautions because I've heard that they will go after you just the same as texting no matter what you were actually doing with the phone so it can be a he said she said argument.

If there is no data action after 5:42 then HELL yeah fight it - I drive with my phone in my hand all the time - Same as if it were a soda, pen, etc etc - Can you REALLY get a tix for just holding a phone now? - "I was waiting for a call and if it were to have come in, I would have pulled over to take it hence me holding the phone and a copy of my data plan clearly shows that nothing was sent at the time I was pulled over - At 5:42 I received a text but had not even looked at it yet because I was driving" - BLAMMO, done

thats what i am thinking. but the cop can say anyting he wants...he actually pulled her over at 610p and had her written by 615p. but the tix says 610p. i am just converned it is too open for interpretation. and of course when its up in the air, in terms of tickets, you will always lose.

I agree with Bug and Steve. The cop can say whatever she wants, the ticket shows 6:10. I'm assuming that's what time the traffic stop was initiated.

One thing the cop might argue, however, is that even though the text was received at 5:42 your fiance could be reading it at 6:10. Just because that's when it was sent doesn't prove that's when it was read.

Question I have is what if your phone doubles as an ipod and you where just changing the music you where listening through the vehicles stero system???? How the hell is the cop gonna write you a ticket for that???

Is the ticket for "texting while driving" or for "distracted driving"? You will have to look on the ticket to find out what is the exact violation. The cop said it was for "texting" that doesn't mean the violation is specifically for texting. If it is for something more ambigious you may be shit out of luck.

"includes 10 used-car dealers or auto repair shops, 11 liquor stores and bars--two of which advertise lingerie fashion shows and a third billed as a "gentlemen's club"--three cut-rate motels and one trailer park. The squat, brick municipal building is next to a currency exchange and a few steps from an adult video store. The bars open at 10 a.m. and close at 6:30 a.m."

it all works out in the end.

the better idea is just put the phone away. when i get in the car my phone is two places, in my pocket or my bag. it rarely comes out of those two places when i'm in the car, and if it does, its at a red light, no movement.

i see assholes everyday, texting, reading the paper, doing their makeup, playing with the radio. drives me bonkers. the only people who actually pay FULL attention to the road is bikers.
