No Seat Belt and Speeding Warning

Alright so this morning I slowly passed an unmarked car while seriously just keeping up with traffic on 88. He pulled me over and did all the normal ego tricks that cops do to try and make you admit guilt. Well regardless he gave me a written warning for the claimed speeding 62 in a 55 even though he was likely doing 60 himself, and then the same warning had a no front plate on there. I had to sign the warning, I have never done that before. Then the ticket for the no seatbelt which he claimed to have on video even though I told him I took it off to get my wallet out.

The seatbelt ticket says I have to go to court, WTF is that all about? Did I some how seal my guilty fate with no supervision because I somehow admitted to speeding by signing the warning? I do not want to drive back out to Wheaton to go to court.

Thoughts? I have access to a lawyer if anyone thinks this would warrant one.

The warning just shows that he was working and had a reason to stop you. As for the seatbelt ticket... I dunno. I don't believe that goes on your record, though... just a moneymaker for the agency that stopped you.

Ride smart... stupid hurts.

Alright, well if it is just a money maker then I will pay it, but a no seatbelt guilty conviction on my record would certainly affect my insurance.

If you really had your belt on, go and fight it. He has it on camera? he better have some high tech shit installed in the squad in order to be able to see that. have you seen cop shows? They do not have that type of cameras and it sounds like you were punked.

I wasn't wearing it so yes I am guilty. There is no cop bashing so I can not tell you why I feel I was really pulled over.

AS long as it will not be on my record I will pay it. Still going to check with my lawyer freind.

gotta watch out for those unmark's. They get approved/ bid out to drive those so you have to produce the #'s to get one. So the the ones that are driving them are writting alot of tickets to maintain their ride.
As for having to appear in court, that makes no sense, its a non-driving offense with a max fine set in the statute (I think $55) so something else is going on. Normally seat belt tickets are written on compliance forms, they are like parking tickets, and are about $25 or so and you send in the fine but I'm guessing he wrote you on a y-complaint form (Yellow/white) but still to make it a must appear is wierd. I will try to find out some more info for you so you know what to expect.

Looked up statue today, max fine per the statue is $25, not $55 like I had listed earlier.

yeah if it is a "full" ticket (not a local/parking type ticket)so it requires bond so he took your license. I am in cook county so I am not 100% sure what dupage does but cook hands you an envelope with choices of what you want to do (take the fine, take driving school, plea not guilty and get a court date) but again this is for moving violations not a seat belt ticket. Did he hand you an envelope with this type of stuff on it?

Yeah he gave me an envelope but it is less then clear. It tells me that either way that I plea, guilty or not that I have to put not guilty and get a court date which seems ridiculous for a stupid seatbelt ticket.

I agree, most towns (again my knowledge is cook co.)its just a parking ticket, send it in and thats it. no license for bond or court date. My guess is that dupage wants you to go to court so that they can charge you a court cost fee ontop of the fine for the no seat belt ticket (since the fine for the seat belt is already set by the statue) and thats why they write it on a state ticket so that you have to post your license for bond and have to go to court and pay the fees to get it back. $$$$$$. I will try to find a contact in dupage to see if this is the game they are playing.
