Traffic Violations Advice Corner Got screwed lately? Get advise from others that dealt with it.

Ticket when I wasn't speeding!

So I was in a western suburb on a 3 lane road riding my bike. I was behind a car in the far left lane, then center lane was open and in the far right lane about 2 car lengths ahead was an SUV.

Doing about 50 mph in a 45, I noticed a cop about 1/4 mile ahead. Not feeling guilty or anything I moved into the center lane. The SUV on my right was advancing taking the cop out of my sight. Then all of a sudden started to brake. I see the cop make a movement and as we passed he darted out. I knew the focker was coming.

Dude pulls me over and says I was doing 71! I went fooking nuts and told him it was impossible! I asked politely for the radar and yes it read 71. I told him what I'd done (movement into center lane, saw him in advance) and he stood his ground and said he pinpointed me with the scope like mounting atop the radar gun, which is impossible because the SUV took me outta his sight, then the SUV slowed down! The damn truck was pulling away from me and the car that I was behind was still further ahead than I.

In the end he gave me the opportunity for 1 year probation and took my license. WTF! If he was so adamant about my guilt why didn't he give me a ticket? I want to fight this but am unsure of how the court system works out here. What chances do I have in front of a judge? I guess it'll be my word versus the cop and I assume those leaches stick together.

For you guys who have been in court, should I chance it or give in to the system of law.

You'll hear this a lot: Get a lawyer. If you really were going 50 and not 71 then you'll need a lawyer to help prove your innocence.

Never a bad time to climb... unless the weather is really horrible, and then you climb inside!

I would. If that's really the case, what a tool (the cop that is).

I've gotten out of few tickets by pleading not guilty, and the cop not being there so they just threw it out. (and this was all in IL).

I've never heard of a cop giving you the opportunity for probation right on the side of the road. Unless I'm not understanding something ????

Go to court and plead not guilty. But DO NOT say you were doing 50 in a 45. You were doing 45 in a 45 - period. Explain everything else and the judge will most likely side with you if you dress nice, have a good polite attitude - all you have to do is create reasonable doubt. I have done this three times. I have not lost yet.

You will get to ask the officer questions and most likely he will not have the right answers because he will forget by the time you get to court. For example ask about traffic conditions. He will say you were clearly visable and then you can point out to the judge that this is not correct and explain about the SUV.

People on here think I am full of crap, but I am telling you how I have beaten three tickets and one was for 86 in a 45. You DO NOT need a attorney. That is a waste of money in a case like this. Just keep your cool.

If you ain't with us, then it's just bad news.

Plead not guilty but sure as hell don't admit to doing 50 in a 45 either. Draw down the configuration of everything: Where the cop was, where you were, the other vehicles etc. Show that from that point of view the radar gun was most likely to get another driver's speed and not yours. DO NOT ADMIT TO GOING 50 in a 45!!!!!!!!!!

Hmm...i'll pay you the cost of my ticket if you can help me get out of mine!

not really possible i think though, was going 73, in a 55, on 20 wb towards rockford and only car on the road when cop passes me on a turn at night

Well, went out of character. Normally passive, I just defiantly responded "That's impossible!" I asked for proof. Which he said "I don't have to" and I replied "Well as a gentleman to another can you please provide the proof." I didn't yell and addressed him properly.

So attending court, keeping my cool (easy), and questioning the officer should prove worthy?

I got out of mine and its very easy. All you have to do is outsmart the cop.

I have a digital book that tells you exactly how to get out of tickets. It tells you the questions to ask and what to say while standing in front of the judge. I got out of a 85 in a 45 zone going down Rt. 59.

Ill upload the file tonight to my web server so anyone who wants to download it can.

And jrock is right, no need for a lawyer unless you are on the brink of a felony.

Edit: I work 3rd so I don't miss anytime from work to attend court, for those that wanna point out loss of wages

false ticketing

I got pulled over about a month ago in my wifes mini-van. The cop was on the side of the road doing radar as I approached him he started moving forward with no signal or lights I slowed down to let him get in from the shoulder of the road ,than he turnedhis lights on and waved me ahead of him pulled me over and gave me a ticket "failure to yeild for an emergency vehicle" Bogus

Radar also has a tendancy to pick up larger objects.

I would also mention the cop offering you probation if s/he is in court. I'm sure the judge will LOVE that.

dress nice and plead not guilty all the way thru, your going to have to take some time out to wait till the end and the prosecutor will pull you to the side and negotiate a punishment for you which you then deny and say that you innocent completly and go from there.

Take your lollipop and flinstones bandaid and have a nice day.
