IL DUI's in 2009

From the Daily Herald:


First-time drunken-driving suspects will find life to be more difficult after Jan. 1st.

That's when a new state law takes effect requiring a breath alcohol ignition interlock device to be installed for first time DUI suspects.

Anyone who wants to continue driving while fighting a DUI charge must obtain a monitoring device permit allowing them to be behind the wheel during license suspension.

The gizmo also must be installed in the suspect's vehicle. The new law requires people to take a breath test every time they want to start their vehicle and at periodic intervals after the engine has been started.

*****Also, The suspension period for your DL will increase now too. If you submit to a breath test, your DL will now be suspended for a minimum of 6 months (perviously 3 months). If you refuse, it will be suspended for a minimum of 1 year (previously 6 months).

Met a guy not too long ago who installs these then went and got a DUI himself. He's royally screwed because he doesn't qualify to get one installed because he installs them.

Do everyone a favor and take a cab or get a DD.

Last I heard the first DUI in Il averaged the convicted an $8400 expense & for most includes a suspended license, lots of mandator counseling & court monitoring/probation.

Those do more harm than good. I also installed them, and they wanted you to blow in them while the vehicle was in motion, as well as to start the vehicle. If you blew with alcohol on your breath, the car would still run. But it would record it and be downloaded then you turned the machine in. Talking on your cell phone is illigal, but driving, looking for a straw when the beeper on the machine went off, picking up the machine, and blowing is legal. Did I mention the state charges a huge amount for installation, removal, and rental of this machine?

Are they saying that you get it installed before you are convicted?

Now I don't approve of driving under the influence at all but shouldn't you have to be convicted of a DUI before they get to charge you, and install such a device? Just being charged with the crime, is not the same as being convicted. Is it possible the article got it wrong?

"If you submit to a breath test, your DL will now be suspended for a minimum of 6 months (previously 3 months)." I'm also assuming this bit refers to if you blow over the legal limit?

Come up to WI where you can get your 13th dui and still keep your license. Why do you think Drunk driving is WI's pasttime.

Personally the 1st should be the one you learn from NOT to do it again. Mandatory 1 yr suspension, $5,000 fine and 6 months jail.

2nd 5 yr suspension, all plates belonging to the dui asshat are revoked, 1 yr jail, $25,000 fine, mandatory AA and 5 yrs no alcohol allowed.

3rd time. You are done. Banned from driving or registering a vehicle for life. 5 yrs prison, felony charge, $100,000 fine, 10 yrs parole with no alcohol provision.

Caught again after the 3rd, 20 yr prison and another zero added to the fine.

kill while dui, charged as 1st or 2nd deg homicide. No more slap on the wrist vehicular homicide while dui crap.

I don't think it will make a difference. Sounds like a huge waste of resources. Perhaps they should focus on prevention instead? Better yet just make alcohol illegal.

Yea like almost everyone here hasn't driven after drinking??

Total BS law. I'm sorry but what is it 1 or 2 beers in an hr would give you a DUI?

Most people wouldn't get much of a buzz not alone drunk off that unless they kept going.

So you're blaming lack of public transportation for drunk driving? How about this... Don't drink too much if you know you're driving home. It's not like having to get home comes as a surprise. Really I would rather just make the first time a class B Felony and loss of license for life. That would be a 25yr sentance. I dont care if you like it or not.
