Need help!!

So my sister (18) got rear ended by another car. She took down the info from the guy and took a pic of his I.D. (i think, this is what she told me). There were two other people in my sisters car. The guy was alone.

I have his address, name, phone number, insurance info and plates. He didnt want to call the cops and my stupid sister agreed. He said to tell him how much it would cost and he would pay. They both left the scene.

So I tried calling this guy and the number is disconnected (surprise surprise).

What is the best way to handle this situation at this point?

I'm thinking of just going to the police station right now and explaining the situation. Can I file a hit and run against him?

I can't believe how stupid my sister is.

Talk to the cops WITH YOUR SISTER since she is 18, a legal adult AND involved...and let them guide you on how to proceed. If you can get them for a Hit and Run, then he can get your sister for a Hit and Run... but a Hit and Run isn't what technically happened so forget that angle... Go explain the situation to the cops and ask them how they think it would be best to proceed... they may take the info you have and make a report...who knows..

New twist:

So the guy just called. He made a "mistake" when telling her his number (he took her number as well).

He wants to "settle" but I'm not sure what the extent of the damage is. He mentioned that he doesn't have a problem with filing a report but he said he'd rather just pay for the damages.

I think I have 24 hrs to file a report. My gut tells me to go through the police and get everything documented. I have a feeling I'd be chasing this guy around if I did it any differently.

I'm gonna go take some pics of the damage.

statute of limitations on a traffic accident is 5 years for property damage and 2 years for personal injury. You said everyone was Ok just car damage so don't freak out, take your information and talk to the police/insurance. http://www.illinoisprobono.org/index...contentID=2116

dont get screwed. go to the police and do it how its suposed to be done. its the guys fault for hitting u and if he doesnt have insurance or for some reason doesnt want it documented with the police there is a reason (has a warrant, no insurance, ect) and that is his problem, not yours.

the guy can always sue your sister saying it was her fault. So I would go to the town of the accident and file a report and call the insurance agency.

if the guy tries to do a lawsuit, your insurance takes care of it.
