Lending a gun?

I have a colleauge who's shopping for a 20g shotgun for his teenage son to shoot trap and hunt with. My preference is for him to buy it, but he wants to try it out first.

Is lending a firearm legal if Im not present? Do I need to have him sign some release of liability? Or am I just being paranoid?

I also dont want the gun to come back dirty or scratched in some way and cause an issue.

Everything is pointing to this being a BAD idea. Maybe I'll just join him at the range.

I've lent firearms to others before. IIRC, and I'm no lawyer, as long as he has a valid FOID, he can transport & use the firearm.

Presuming I'm correct on the legal aspect, it is then simply a question of how much you trust the friend with your firearm.

Bad idea. Firearms like your woman should only be handled by yourself.

There is a liability issue if the gun "misfires" either injuring someone else or the shooter. People have been tried for stupid shit when it comes to guns. Remember that guy the government went after for the "automatic" rifle that misfired after a buddy borrowed the gun.

If its a nice gun, clean condition, I wouldn't lend it out anyway.

if it was family, ok...i can see that. but a coworker? no way.

it's bad idea for sure. regardless if he has a foid or not, you do not know who else will be there and who will be handling it. certain things should not be lent out and firearms are one of them. bikes would be another!

if there is an incident, one of the first questions is going to be, "where did you get this firearm?" and invariably, you are now involved and may even be liable, for whatever has happened...directly or indirectly.

just say "its a liabilty issue and although ud like to, you cant."

Even with supervision, it's a matter of gauging their level of responsibility.

Exactly. You don't need someone pulling a Dick Cheney. Not because I would worry about something in court arising, but because I personally would feel responsible if someone were to get hurt due to a firearm I lent out without me being there.

Thats a little bit different of a situation. You are talking about a 22 year old gang member whose job it was to "hold onto the gun incase other gang members needed it" and his defense was that he was pressured into joining the gang when he was 12. Poor him.

lending a gun technicaly falls under the transfer of ownership and would require some type of bill of sale such as the document I posted years ago even though no money changed hands. And then another one would have to be drawn up when it is returned. This will suffice the eyes of the law in the transfer of the firearm. Now if it is returned to you in a condition not acceptable becomes another matter.

I guess.. I just borrowed my friend's family's 20 gauge single shot shotgun to shoot trap with; for a week (went two times). :P We've known each other for 20+ years though.

My buddy did come out to shot trap with me the second time though.
