AR pistol question in Illinois

Is it just a matter of having the ffl register a stripped lower as a pistol vs a rifle when you fill out the paperwork and waiting 72 hours vs 24? I know some lowers are marked pistol, but I have seen many builds that are not.

Yup, for example we have only Rifle lowers in stock, If we transferred them in as a Pistol lower then it just gets repeated onto the 4473. Its not just the 4473 but the FFLs black book.

So the FFL has to have the shipper specify they are to be pistol lowers? Does the FFL have to do paperwork with the shipper acknowledging the fact they will receive lower? The ffl was already on file with shipper. I guess I am not clear if I can wait for ffl to receive the lower then when I fill out the 4473 they can specify it is a pistol.

yup, received as a pistol lower by the receiving FFL, doesn't need to be shipped as pistol.

my stripped lower that I use as pistol was received as "receiver" by my FFL. as long as it did not say rifle on the form - you can use it as pistol, in my case, I can use it as both as long as the stock and shorty upper never end up on it at the same time

I had read and it is to my understanding that if it is ever assembled into rifle form it can never be a pistol again.

yeah... don't think so...if it ever was registered/transfered as a rifle, it can never been pistol, what it was assembled into... good luck finding out this would be unenforceable

If the virgin receiver was FIRST assembled as a rifle, it can never be made a pistol. If it was made into a pistol first, then it can be switched back and forth as many times as you want, just make sure to NOT have the pistol barrel on it with the stock (then its a SBR). Now proving it to a over zealous cop that it was a pistol first may be a fun time.

Dealers up here check them off as "other firearms" (as they should). Now there ARE some companies that sell some receivers as "Pistol" to make it more obvious that its a legal pistol when its in pistol form.

I'm not crazy, my mother had me tested.

Well, I just sent my Form 1 today, so hopefully it will be a moot point for me in about 6-8 months, my 7.5 upper will move from my pistol lower to my SBR

BTW, I found an engraver in Deerfield area that will do the receiver engraving while I wait for $30

I thought SBR was a no-go in Illinois? I went 10.5 for my SBR, with a 7.5 quite a bit of velocity was lost.

it's a go since January, with some additional hurdles. I will have a 10.5 upper as well, but since I already have 7.5, thats what went to paperwork

Yeah, I'm still behind. I've had my C&R filled out, just haven't sent it in yet. Maybe I can get off my butt tonight.

Link to some details on what is needed? Last I read it could only be done with a FFL for antique firearms and for re-enactment purposes.

yes, I got my C&R FFL - took just under 2 months and set up a trust so I don't have to get Cook Co Sheriff or Buffalo Grove PD sign-off - that took 8 pages of legal size paper and $3 for Notary public

filled out Form 1 and mailed today, will get the lower engraved with my trust name and the town info on Saturday.

AR pistol question in Illinois

Stripped lower goes on the books as other. It is not a gun not it is a riffle at the moment but you still need an FFL

72 hours starts the minute your FFL agreed to get it

What diff does it make how it was registered before

If all I got was stripped lower than that is what I got and what goes in my books
