What's the law on selling firearms?

To support my track habit, I have to sell my firearms which includes a .22 cal rifle, and a couple of handguns. Anyone know what the IL law is on how to properly sell? Do I have to ensure that I'm selling to another FOID card holder or doesn't it matter? Do i need to involve an FFL for the transfer? If so, who usually pays the FFL fee, buyer or seller?

Any advice would be appreciated!

keep your transaction reciept, and why would you sell it to someone who dosent have a FOID card in a state that requires you to have one.

Willard: When I was home after my first tour, it was worse. I'd wake up and there'd be nothing. I hardly said a word to my wife, until I said "yes" to a divorce. When I was here, I wanted to be there; when I was there, all I could think of was getting back into the jungle.

I know stores won't sell it to a non-FOID card holder. I don't know if I have to do the same or not. I'm just asking.

I'm going to sell my Ruger 10/22 with folding stock and a couple of 25-rnd banana clips. Also my S&W 686 6" barrel stainless steel revolver. Might also sell my Beretta 92FS with a couple of 15-rnd clips. I have no clue on the prices, although I do want to move them quick so I can afford more track days in Sept.

Read the back of your FOID card.

Do not sell firearms or ammunition to anyone who does not have a FOID card.

Also it states to keep the transaction paper work for a period of 10 years.

Thanks Scout! Who woulda thunk it that there are instructions on the back of the FOID card.

It didn't say anything about having to go thru an FFL though. So I guess I don't have to?

If you sell only a couple items I think you good.

Document everything however. Copy the persons FOID card if possible. If not be sure to document their name and FOID #.

no you dont have to go through anyone or notify anyone that you sold a firearm.

i know when i sold my last firearm, although it wasnt in illinois so they didnt need a foid, i still got a copy of the Drivers license just to be on the safer side.

FFL's are only needed if the firearm is being shipped.

Presuming you are doing a person to person transaction, to another resident of the state of Illinois, then yes, you are obligated to ensure that they have a valid FOID card. You will need to create a pair of receipts, which will have explicit information regarding the firearm being sold, personal information of both parties, FOID #, etc. I would also strongly suggest making photocopies of BOTH FOID cards. Both parties are then required by law to retain these records for 10 years.
