Interesting surprise today...not getting what I expected, but cooler *NOW WITH PICS*

So I'm in Michigan picking up the 2 guns from my grandpa's collection. My Dad told me he had a shotgun and a .30-06...Well the .30-06 is a Browning and in real nice condition. My dad loves that gun and will probably keep it. The bolt is kind of jammed so I have to help him out with it. It has a synthetic stock.

My dad however was totally wrong on the shotgun. Don't know how he screwed this up, but it's a bolt action rifle. Looking at it, it's bolt action, has a great wood stock, and looks to be in old decent condition. My grandpa was came to the US from Italy, but lived in Cananada for a while and was in the coast guard. This gun looks to be used by Canada in WW1, but it also was sold commercially. I'm trying to figure out where this came from. This gun has "Ross Rigle M10" stamped into it. Here is what I found out about it. http://en.wikipedia.org/wiki/Ross_rifle

I guess fucking with the ATF doesn't bother you much. Does the prospect of being ass raped in Federal Prison for an illegal small arms transfer strike your fancy? Seriously dude, I told you about this, pull this thread before this bites you in the ass. Illegal transfers w/o background checks across state lines is serious business, this was a stupid move.

According to Garret a licensed FFL at elgin transfer LLC that I think you use also) it's not a problem to do with rifles. It's handguns that are a problem.

Just to be on the safe side, I would inquire regarding the differences between possession (which is what you're doing) vs changing ownership (if you were "take" then from your father). I don't know what the distinction is, as I've never been in this situation, but it strikes me as something that would also be important to be aware of.

It's still Illegal Steve, handguns must be transferred within state if not going through an FFL, rifles can be transferred TO AN ADJOINING STATE without shipping but must be received on your end at an FFL, this is still an illegal transfer.

"may purchase or obtain" - To me, a non-lawyer, I am uncertain whether this covers such temporary possession situations, vs actual transfer of ownership.

Aaaaaaaaright!!! I'm only chiming in here cuz I delt with this before. We asked an officer about this. It's really a shady area around "taking posession" and "purchasing" He is inheriting, which is really taking posession. However, being this is a grey area it's possible this could cause trouble down the line. Realistically, an officer could arrest you for this and let the court sort it out. We were advised to go through FFL. Personally, I feel the possibility of the gun ever being run for numbers and then a judge not being sympathetic about the grey area and any "ignorance" involved, are slim to almost none. So whatever you choose should be respected

I'm not looking to break the law here, but don't want to pay and deal with a FFL if not needed...so..I called ATF in chicago.

The girl in charge of this was real nice and helpful. After explaining the situation to he she said....actually I don't know. It's kind of a unique sitation. Since it was my grandpas, it could have been left to my dad or me or anyone in the family. since its kind of between my dad and me she said I could possibly claim owning it or just using it as I prefer. She said she has to do some more research and will get back to me.

If this question is that grey to an ATF I highly doubt that a cop is going to arrest me.In the end though I'll abide by what ATF person says and if she says i can just transport the gun myself i'll make sure i get it in writing.

I have a friend with an M-10. I'll ask him if he has any info/links he can share on it.

I know there is an Aussy company that's making modern versions of them...I fired one that was chambered as 7.62 and I believe took AK mags. It was a fun rifle to shoot, but I enjoyed the Swiss straight pulls over it. (I have a swiss on the way!)

Yeah I know...no big deal. I talked to the ATF agent and here is what it came down to. If the guns were left to me, there is no problem with me taking them and transporting them. If they were left to my Dad, then they need to be transferred to me via an ffl now that I live in another state.
