still nobody answered my question, if a person gave you a car without telling them something safety related was over ridden, and YOU damaged that persons car, would you just open your wallet and give out money?

If it was using a device that they shouldn't be using, yes. I think that without knowing how the remote was setup, this debate is worthless.

Need more info.

Do we know for certain the owner did or didn't tell the dealer it has (had) a RS? If he did- the dealer is instantly at fault. Furthermore, why did he even leave it functional when he dropped it off? Set it in valet mode or don't leave the fob with the car.

Even though the porter shouldn't really have been using the RS, he could have thought he was just unlocking the doors. I've seen some fobs that have little or no labeling. Though he should have gone the prudent route if he didn't know what the buttons on the fob did and just unlocked it with the key.

Still say the owner. Might as well say he can't turn the radio down or turn on the windshield wipers when it's raining. Maybe they should hire people to push the car in because the owner runs his car with no oil or hadn't been changed in 50,000 miles (which I know personally been done).

BTW - I say owner for bypassing a safety feature.

Not only is his car totaled, but he has to go through life being stupid, and nothing will change that.

Owner just because installing a RS that can start while in gear is moronic. I know many people that put the car in gear instead of using the parking break.

My name is JB, people call me JB

I was wrong and I deserve to be hung by the masses.

Is that what some of you retards wanted to hear? The porter SAID he was simply trying to unlock the car and I can see where if the buttons are not clearly marked or have been rubbed off and the guy pushed to wrong button that it wasn't his fault. Even so he shouldn't have used the aftermarket remote to unlock the car but nobody actually does that anyways.

may not have a choice. oem fob is likely removed from the key chain. and if that system included an alarm, the only way to easily disarm it is to use the included fob. sure there are valet modes, but no way the dealer knows how to access that on every model out there. and obviously the custy didn't freely hand over the info on the makeshift starter installation, so why would he tell about that?

When I used to valet we were never supposed to use the key fobs to begin with, aftermarket or oem. so he did have a choice if everyone did not use the key fob and used the keyhole in the door to lock and unlock. of course many cars don't even have keyholes anymore so that kinda throws that out the window

most cars now since the keyhole is used so infrequently, the alarm will no longer disable unless you hit the factory key fob.
