Not neccessarily, Everything is bargaining power. If she is a stay at home mom, your pretty much screwed. If she works and makes more then you, and has a 401 herself she also has to split hers.
The scariest thing about divorce court is there are no defined rules, except for child support.

The 401(k) Balance would certainly be considered part of the maritial assets, but it depends on if she gets other assets to equal her share of the disolution. If the majority of your assets are in the 401(k), then yes, probably. This is all subject to a QDRO (Qualified Domestic Relations Order) and is entered into the court as a seperate document from the rest of the disolution papers. This is all subject to negoiation, and kind of depends on her assets as well as yours, and any other offsets, and on how good your lawyer is.

Also depends on how much was in the 401(k) before marriage, and how long you have been married.

Everything is up for negotiation if she's willing. Trade something she wants for something you want. If the lawyers are good and you can work things out peaceably and present it to the court they'll give their blessing and you both will be on your marry way. I got to keep all my 401k and we both kept our own debts, of course we were married very young, both had the same college degrees and therefore theoretically the same earning power. If you don't get along the court will do as they deem fit and more than likely 50/50 or she'll get your house and the clothes off you're back while you pay for them the next 30 years.

+1 on paying for a very good lawyer

+1000 on marrying someone you'll never divorce.
