Just a warning about driving in WI after Dec 1....

...if you like to text while driving. Its now illegal in WI to text and drive as of Dec 1, 2010. Also its a primary offense so if they see you texting, they will pull you over. Fines can be up to $400 and 4 points for the 1st offense and $800 and 4 points for the 2nd.

I'm not crazy, my mother had me tested.

That's great but how can they prove you were texting? I've seen some opinions that laws like these just make it worse because people hold their phones lower so they are out of sight taking their eyes that much further from the road.

how clearly is that law...can they prove I was "texting" what if I was looking at my phone. is it also illegal to just look at your phone. If i take it to court how do they prove i was pushing my buttons and texting. So much grey area there....???

I thought the law said something about using any electronic device or some shit without handsfree or whatever. I'm sure the law is written to eliminate any obvious gray areas.

It all falls under distracted driving, regardless if you were texting, emailing, flipping through your contacts or whatever. Distracted driving laws pretty much mean it's illegal to do anything behind the wheel aside from driving.

Take it to the STREETS!

It has been a law here in Michigan since August and there is already a huge outcry to repeal it. The texting while driving has opened up a huge debate about it's true benefits to saving lives. People now just keep the phones lower and eyes off the road more. Since the passing of the law accident rates because of texting have skyrocketed. Plus there have been many instances of people being pulled over for it and given tickets with no cell phone in the car (privacy issues?). I fully agree that there is a problem with texting and driving, but it goes hand in hand with other issues that are just as distracting, but yet there are no laws that are being broken. It just gets the most attention now because it is the new thing to point fingers at instead of the other problems the finger pointers are guilty of as well.

Well they can get your phone records from the cell company.

Most people doing this are weaving and varying speed drastically while texting.

The police will request your phone usage for "texting" and show that you sent or received a message around the time they pulled you over. The only way you might get off is if you only received and did not send a message. Talking with my cop friends up here, they won't pull over a person just for texting, but if they're weaving or dangerous.

Personally I think it's a good law, might need to be tweaked a bit, but the principle is right. In general, People should be doing nothing but driving. If you cause an accident because you were texting, I would have no more sympathy than I do for that lady painting her nails.
