A Michigan man faces up to 5 years in prison for reading his wife's e-mail to find out if she was having an affair, the Detroit Free Press reports.

The newspaper says Leon Walker, 33, of Rochester Hills, has been charged with a felony after reading Clara Walker's GMail account on a laptop the now-divorced couple shared. He goes to trial in February.

Oakland County prosecutors used a state statute typically used to prosecute crimes like identity theft or stealing trade secrets, the newspaper says.

Leon, Clara Walker's third husband, found out in an e-mail that she was having an affair with her second husband, who was once arrested for beating her in front of her small son. Leon Walker showed the e-mail to that son's father, Clara's first husband, who filed an emergency motion to obtain custody.

"I was doing what I had to do," Leon Walker, a computer technician, tells the Free Press. "We're talking about putting a child in danger."

Oakland County prosecutor Jessica Cooper, in a voice mail to the newspaper, calls Walker a skilled "hacker" who used his wife's e-mail "in a contentious way."

In preliminary testimony, Clara testified that while Leon had bought her that laptop, it was hers alone and that she kept the password a secret.

Leon Walker says he routinely used the computer and that she kept all of her passwords in a small book next to it. "It was a family computer," he says. "I did work on it all the time."

He did not hack gmail to get it. She was dumb enough to store the password on the shared laptop or had a weak enough one to be guessed.

Personally, I don't think he actually violated the letter of the law on this one -- which is why you don't see more prosecutions like this. She's just trying to divert attention away from the fact that she got caught.

Doesn't matter who cheats or who leaves their email unsecured. Unsecured email has no reasonable expectation of privacy (from a criminal perspective) -- especially with a free email account to boot

If I have a password on my email account, I have a reasonable expectation of privacy. Whether I keep that password written down doesn't matter. You would be accessing my email without permission using a password that was not given to you.

If my g/f found my SSN and mothers maiden name in a folder on my desk and used that information to access my bank account, it would be identity theft. It would be my stupidity for leaving it out, but still illegal. The email password is no different.

Now if he can prove she gave him the password to access her account for another reason, he will get off.

The fact that he was charged with a felony and prosecuted under a statute used to "prosecute crimes like identity theft or stealing trade secrets" according the article is what's fucked up. There is no doubt she had the right to her privacy, its just bullshit that he was charged with a felony. Misdemeanor, maybe. Felony, hell no.

Not convicted, just charged.

Hopefully a jury will see how stupid this is and not even consider a guilty verdict. Either that or a judge throws it out before it even gets to a jury.

Well, yeah, agreed. The felony part is stupid for what they're prosecuting him for. I don't see the trade secrets thing...... and the identity theft, well that's a bit thin. Identity theft is more malicious or the intent to use someone elses identity for personal gain. Can't see that being pinned on the husband...... but he's going to have to fight that one in court.

However, it's illegal to open someone elses snail mail with the intent of discovering secrets, etc. The husband opened her mail, without her consent, with the intent to determine if she was cheating. If it had been physical mail, he would be screwed, and prosecuted under that law.

I don't think there is an equivalent law for email though.

Agreed. One could argue and say that it was identity theft because he used her password to log in as her. So I could see that side of the argument. But I still think its a stretch.

The law regarding email doesn't treat it like identity theft. This was a gmail account (A free service). The people who actually pay to support the service are the advertisers -- not the users

it is truly amazing that the county prosecutors made the time to pursue this - must be a boring county with absolutely no real crime whatsoever.
