Am I Hallucinating...

Or is my boss being totally out of line?

I crashed pretty hard at the CCS race practice in turn 2 at Blackhawk August 19th and was airlifted to Rockford Memorial. I was released 3 days later with a number of ailments but nothing life threatening. I call my boss on Sunday saying I won't make it into work for about a week.

I went back after 1 week because I felt the stigma with motorcycle crashes are already negative and I did not want to jeopardize my job or working relationships. I was fully prepared to use 5 of my vacation days for the time I was off. When I get back my boss says he did me a favor and got me 5 days of short term disability so I was paid my hourly wages for the week (I'm about 40% salary 60% commission BTW).

I have 9 days of vacation left that I must use for 2012 or I loose them. I requested a week off today and while I was not restricted, I was given the riot act about how he did me a huge favor by granting the disability so I could afford to pay my bills. He also suggested I don't use all of my vacation days because of this massive favor done for me.

I know there are always 2 sides to the story but he is known for giving people grief about taking vacation. This one threw me back though.

I don't know if he has a point or if he is totally f-ing nuts. What do you guys think?

While out of line (ie, your boss is totally fucking nuts)....... I would voluntarily give up 5 days of your vacation. You were going to use it anyway for the week off. Consider it paying the toll.

The other 4 days, I would talk with your boss to figure out a good time to use it. Tell him you appreciate his "favor" and will limit your vacation the rest of the year, but that you do have a few things that need a day off here and there.

Whether he did or not (sometimes that Favor.... isn't really a Favor), he felt that he stuck his neck out for you and that's all that matters. If you plan on working with this guy for years to come.... you need to return it.

Thank you. That makes me feel a little better. That is how I plan on handling it because it's not worth the ramifications.

The fucked up thing is I have a suspicion that the option was offered to him by my employer, not something of his own doing (I think he just relayed the message). I just find it hard to believe that in his mind me trading 5 of my vacation days for 5 short term disability days is a huge favor.

Some favor .... If you had used vacation, you would have been paid at 100%.

It is not reasonable for them to ask you to not use your vacation without compensation.

Check with your STD provider (heh), I was under the impression that they usually require to atleast take one week out of your vacation/sick time

Pretty simple you were out on medical not a fucking thing they can do to you.I would use the days off how ever you want and if there is ramifications well then that opens other doors they might not want.

go time traveler style and go back in time, fuck his grandma, then shoot forward in time and then fuck his mom. Then return back to present state and call him a the product of two incest whores and hes your son and show video of you plowing the both members of his family. .

If you or your employer pay premiums for short term disability, you should be able to find out the conditions under which you qualify (do you have to use vacation first, etc). I know our policy doesn't kick in until you are out/off at least 10 days. No matter, if your employers pays and not a third party, they shouldn't give it to you until you have used up your vacation, otherwise they shouldn't bitch when you still want to use it.

Sounds like you need to have a discussion with your employer because something doesn't sound right.

Short term disability insurance pays you if used. Annual leave comes out of their fringe benefit pool. So the company is pocketing the money they would have paid you for your "vacation" time that will be turned in and having the short term disability pay for your time off. Probably not illegal, but not exactly honest, either.

This makes perfect sense. Like I mentioned before I had a suspicion that someone mentioned this to him because his offer was out of character. Seeing that it would save the company from paying me makes perfect sense.

I actually don't have a problem with that since I was willing to give up my vacation days anyways.

I do still have a problem with it being disguised as a favor. The problem is this job supports my family and it's already hard enough. This isn't a company rule either, this is one of my Boss' rules that was made up along the way.

Its messed up when companies do this, no one should be feel guilty to take time off that's rightly theirs.

+1000, I always give my employees time off when they want it (for whatever the reason is) its better for everyone involved. Your boss is an ass.

BTW/ the TTR90 is still rockin', my kid loves it.

Your boss is being a dickhead. You earned your vacation to use during the year. I don't see where your boss did you a huge favor since the sole purpose of STD is to cover things like what happened to you. I don't know your situation, but you may have an employee welfare benefit plan that is covered by ERISA. In that case, it might be illegal to retaliate against you taking your vacation benefit.
On the other hand, sometimes you just have to bite the bullet to maintian a good relationship with your manager. If a couple lost vacation days means being a "team player", then that may be worth it in your case.
