I got pinched

I just got nailed for speeding in Oak Brook this morning trying to get to work. 56 in a 40. This is the first ticket I have had in 6-7 years. The cop said that he wasnt giving me a ticket. He was going to give me a "city citation". He said this wouldnt go onto my record and my insurance wouldnt know about this so my insurance rates wouldnt go up.

Is this a line of crap? Citation vs. Ticket? Isnt that the same thing? Doesnt it all go on your record also??

does the "Citation" require you to goto court. What is the fine for a "Citation" did he take your liscense or bond card, or did you pay on the spot. Just trying to find out any differences between the two

If you were charged under a state statute, it would be reflected in the violation code on the citation (Ch. 38, Sect. # blah blah blah...).

The "citation" is going to cost me $75. And yes the did take my license as bond.

I cant really find this CH 35 or what ever so I still am unsure.

Why does it matter if it gets on your record??? Ins. co. won't find out unless you change co's within 3 years and it looks like you got room for a couple more within a year before you have to worry about suspension.

Hmm court appearance and the same fine as a reg ticket. Sounds alot like a regular ticket to me.

Nope......not the same....Basiclly its a way for a town to make money. The fine goes 100% into the town's budget. Yeah sometimes they are as high as a regular ticket, and yes you do have to go to court because no matter what they call it, you still have the constitutional right to defend yourself in front of a judge.

But if you are found guilty your fine goes to Oak brook and not the state. they don't report it to the Sec of state. It's like getting a ticket for loud music or something.

Though towns are getting away from this cause the state is starting to challenge these "citations" for driving infractions.

Basicly consider yourself lucky.

as far as taking your licesnse...it's a way to guarantee you'll pay the fine....or they report it to the sec of state as a driving infraction.

Gautam City: I got pulled over heading south on Meyers Road right as I came over 88. He was sitting on what is almost a frontage road.

Why oh why didnt I have my radar detector up when I was going that fast.:-

Yep, and it also leaves the city and city attorney free to negotiate a plea. Essentially, you got a break. You got caught, you pay your money, you get supervision, and don't get caught again in Oak Brook for a while.

This is absolutely correct,............. It happened to me in Naperthrill this year............... you have to be good for 90 days though or it WILL get reported to the state. Basically its a money generator for the city. You pay the ticket and its automatic supervision for 90 days..............Now be good and you'll be fine

by the way there no longer is a chapter 38 the speeding ticket would have been written for 625 ILCS 5/11-601(b) some cops just write the 11-601(b) thats for a state statue ticket. the town could write it under that statue also and check the local ordinance box making it a local ticket. In that case the local municipality gets the $ or most of it anyways instead of a smaller portion.

How do you turn this thing on?

That's it. From now on when I need legal advice, I am coming here. Either there are a couple lawyers out there or people that have been in too much trouble to not understand what is happening. Either way. thank you for the help.
