Calif. men face criminal charge for Xbox tampering

LOS ANGELES (Reuters) - U.S. prosecutors have charged three men with copyright infringement for selling modified Xbox consoles that enabled the original video game machine from Microsoft Corp. (MSFT.O: Quote, Profile, Research) to play pirated games.

The criminal complaint filed in federal court in Los Angeles on Monday named ACME Game Store co-owners Jason Jones, 34, and Jonathan Bryant, 44, as well as Pei "Patrick" Cai, 32.

The complaint alleges that Jones and Bryant sold Xbox systems that Cai modified with chips and hard drives that allowed users to copy rented or borrowed games onto the console for future play.

All three men are charged with one felony count of conspiracy to commit copyright infringement and to violate the Digital Millennium Copyright Act. The charge of conspiracy carries a maximum possible penalty of five years in federal prison.

Lawyers for the men, who will be summoned to appear in U.S. District Court in Los Angeles in late January, could not be immediately reached for comment.

Jones and Bryant demonstrated the modified Xbox game consoles in their Melrose Avenue store. They charged from $225 to more than $500 for the modifications, depending on the extent of the modifications and the number of games preloaded onto the hard drive, according to a statement from prosecutors and the complaint affidavit obtained by Reuters.

During the investigation, undercover agents with U.S. Immigration and Customs Enforcement paid $265 to have a modification chip, a hard drive and 77 pirated games installed on an Xbox, according to the criminal complaint.

Microsoft released the Xbox 360, the new version of its game console, on November 22 in North America. The premium version of the system sells for $400 and is sold-out at many retail outlets.

The original Xbox was released in late 2001 and now retails for around $150. Games for the system cost up to $50 each.

its using the ORIGINAL xbox platform peeps...not the new x360...they would have never been caught is they didnt display it in thier freaking store...they could have just told everyone that bought a box or even inquired about it that they could givem them "direction" on where to get it done...

...plus my gf was with me saying "omg slow down, slow down" and I was thinking "Lose annoying squalk box in passenger seat, afford more mods and have less weight in the car and on the back of the bike"...so i dumped her and I'm single again as usual...HERE KITTY KITTY!!!

Yeah, selling them out of their store was just stupid. Putting them on display was even more stupid. I wouldn't doubt if some cop (or even federal agent) just went in there to buy an XBox game, saw it, and called it in. I'm wondering how long the undercover guys actually were undercover. 10 minutes? Was it on some big ass display in the window?

Typically, selling a tool for the express or only purpose of stealing copywrighted material could fall under a criminal tools statute. But, since it can be used in a legitimate fashion, arguably, like not wanting to continuosly carry game cds while traveling so you store the games on a hard drive, it would be a tough call if the person actually owned licensed copies of all the games stored on the hard drive.

Look at the TOS in teh Xbox's manual and see if it is specifically listed as "tampering is illegal" or along those lines. Wouldnt be surprised if MS put that in.

It isn't mentioned in the manual anywhere. Only thing close is where it says that the warranty will be voided if the seals on the bottom are broken and/or the xbox is opened.

But on the xbox live terms of service...it says this:

10. SERVICE OPERATION AND EQUIPMENT

The Service may only be accessed with an Xbox video game console, the software and/or hardware of which has not been modified in any way (except for Microsoft authorized repairs and upgrades). Any attempt to disassemble, decompile, create derivative works of, reverse engineer, modify, further sublicense, distribute or use for other purposes either the hardware or software of the Xbox or the Service, is strictly prohibited and may result in termination of your account and/or your ability to access the Service via your Xbox, and the pursuit of other legal remedies by Microsoft. Microsoft may take any legal action it deems appropriate against users who violate Microsoft’s systems or network security, and such users may also incur criminal and/or civil liability.

Microsoft reserves complete and sole discretion with respect to the operation of the Service.
