Some guy hit my car this morning.

I'm all pissed off so i have to rant about it. It happened at the roosevelt on ramp to 355S. I rollled through the toll plaza right lane with my I-pass. I saw this blue van slowed down a bit by the 2 cars in front of him in the left toll lane. All three of those cars must have had I-pass cause they moved through quickly and the first two passed my slow civic easily. Well the blue van must have decided to do the same since as the two lanes merged into one he came barreling by on my left. As it moved to one lane I was being run off the road and I honked to notify him to my presence, he then swerved around like he was either startled or crazy. His swerving clipped my left front quarter panel before I could jam on the brakes. Needless to say, I wasnt happy.

What makes this even better is that he told the cop that I had tried to cut him off. I dont think this van even noticed my presence as he blasted by me. Now I dont know what the insurance is going to do on this one. What a shitty way to start my day.

Well...did anyone get a ticket? hopefully that arse did

I have STate Farm and unless i get the ticket in an accident my rates remain untouched.

I had 3 accident claims in the last 2 years and my rates have actually gone down. 2 was a hit and run when my car was parked legally on my street and when i came out in the morning bam.....smashed rear bumpers!!!
The other was some old lady backed out of a Target parking space and kept going backwards about 200 ft until my front bumper stopped her

Hope all works out dude......

Sorry to hear it man... Any idea what the police report ended up saying (as far as what actually happened)? What's the damage assesment to your civic? Still drivable?

Look on the bright side, perhaps this is the motivation you needed to get that low profile bodywork you always wanted...

Sorry Chris,

What did the cop put in the report.?? Did the cop get a witness to straighten it out??? Just remember if he hit you on the front quarter it is going to be awfully hard for him to prove you cut him off. So when you go to court tell the judge that you think the guy is trying to pull a fast one and that you would have to deliberately ram into his back quarter to create that damage on your front quarter. When the judge sees your not a regular to insurance fraud he will see this guys story pretty hard to believe.

no tickets issued. No witnesses stopped to report(but I know others going through the toll booth had to see it). The accident report doesnt detail what happened(thats my job) and neither does it place blame. So I dont know what will happen with this. The car is driveable, the front left quarter is pretty hosed though including the turn signal. Bumper is now cracked too. When I take a turn I get the horrible metal on metal grinding now, I'm pretty sure its the body panels rubbing together since there seems to be no mechanical damage.

Like I said Chris,

it's going to be funny how he tries to explain you cutting him off when his damage is on the rear quarter. Your going to have a strong story cause with damage like that coming away from a toll booth it's going to look like this guy tried to beat you to the merger and failed

dude that is exactly what happened. when I saw he was running me off the road with his failed merger I beeped my horn and then he violently swerved back and forth. i'm not sure if he was startled or was trying to run me off the road. But since there are no tickets this wont go to court. not sure how the insurance is going to handle this.

Call your agent. Let him know what happened. Did you get the guy's info? Your agent will work with his agent and try to determine who is at fault. Unfortunately it looks like he will lie to try and get out of being held accountable--his insurance would have to pay and his rates might go up. If it's found to be his fault, then your car gets fixed and you get a rental until your car is fixed--all paid by his insurance. That is, if you can persuade them that it was his fault.

Regardless, your insurance, assuming your covered, will pay to have the car fixed and then worry about trying to collect money from him--or you. A lot of times, unless there is evidence, insurance companies take the easy way out and let each cover their own damages. This means you're 50% at fault, you pay deductible and your rates could go up. Definitely not what you want.

It might go to court if your insurance company decides to sue his to get payment. But they probably wont, they'll take the easy way out and just blame you 50%--costs them less in attorney's fees.

It's good that there is a police report. It's important to see where and how the accident happened. With him being in the left lane that ends and merging over, combined with the damage on your vehicle, might be enough to prove that he hit you.

Now, who is really at fault could be some stupid rule like you were behind the other guy so you should have let him in and he had the right-of-way. Who knows. Stupid things...

Wouldn't it be cool if people were just honest and said, I f'd up, my bad......

oh yeah, and I dont carry collision on my old civic since rates for a 24 year old male are horrendous. So I'm fucked unless I can get his insurance company to take fault.

Sounds like the left lane was ending, and the van had to merge to the right. If that’s the case, you’ve got the right of way. You could sue him in small claims court (independent of ins, let your ins do the work, but still sue), or go to the ER, and get a lawyer.

It could be fun to start harrasing him at home. Send him a bill, etc. It will take care of itself either way. It’s only $$$…

Chris if that happens give me a call. If nothing else I could get you back on the road with the car. I'll have to take a look but it may be easy to fix. If it is I can help. If you need new panels it may be easy to find something on ebay and I can slap it on for you and bang that unibody back into place. Very true. Sometimes I wish my car was bigger, but its always treated me right so I love it.

And Brian dont worry, I dont plan to harrass anyone but the insurance company. Though I do wish he hadn't lied about what happened, that is quite frustrating.

That sucks Chris! The good news is that in addition to each persons story about how the accident happens, the officer also fills out a report on what he thinks happened. You should wait a few days and petition the police department for the officer's copy of the report. This will give you a better idea where you stand.
