i work for an idiot



So i have a week of vacation that i really didn't plan on using, cause well i have no plans to go anywhere. I have to use it by Thanksgiving or I lose it. So i talk to my boss, and ask if i can just cash it out, this way i can stay at work, be productive and make the company MORE money. He says "Hell yeah", he talks to his boss to make sure its ok, he said "Hell Yes". Now the only thing left is to get the owner to sign off on it. Sit down and chat with him. He says no. WTF? My boss explains to him that if i take a week off, thats a week that the shop is less productive, but if i'm here, i can make them more money. He still says no.

i'm not the type of person who can just sit around and relax. I need to do something, go somewere, anything.

so my only choices for a week vacation is the weeks of Sept 4th, 18th, 25th, Oct 9th or 16th.

ARGH!!!!

Illinois is a payout state. I beleive that means they can not just 'take' earned vacation away from you. They can, however, put a cap on what you can 'bank up'... but they can not 'take it away' from you.

The 'payout' comes into play when you leave. They must 'payout' the balance you have 'banked'. There is no obligation to 'cash' it out while you are still employed.

Again, this is my recollection of what was told to me by our HR people when our company actualy tried to 'take away' vacation in a 'use it or lose it' fashion... Due to this, they simply put in accrural caps.

humm.. can anyone give me more info on this?

cause i have only been here 1.75 years, i have 1 week right now, i get 2 weeks on my 2 year anv. but my boss said i will lose the week if i dont use it by the time my 2 year anv. rolls around.

no, our offices are in that building but I dont work for the merc. i wouldnt say we have money up the ying yang, but we're a smallish company so there are some positives, some negatives though too.

The reason he doesn't want you to cash it out is its basically paying you for an extra week. he has already budgeted for you salary, if you just cash it out your now being paid for 53 weeks instead of 52. he's being a cheap bastard is all. I cant cash mine out either so don't feel bad and I get 3 weeks a year with no time to use it. I can carry over 3 so I have 6 weeks this year. I'm int he same boat. I loose 3 of those weeks if I don't take them by January first, as you are only allowed to carry one years amount of vacation over to any year.

Oh and if you take a week off and have nothing to do, by friday of that week youll be in bankrupcy and strippers will be retiring all over the state

take a road trip on the bike, Thats what I'm thinking about doing with my time.

This is how I take most of me vacation. Long weekends, or interupt the week.

Watch the weather. On nice (ride) days call in sick and say you'll use your vacation. If you can don't give them any notice of which days, that pisses them off.

States that they must pay it out upon termination. This implies that it can not be 'taken away' from you if you 'earned it'.

They can 'cap' you though so you no longer accrue until you've dropped below the maximum 'banked' amount (by taking the paid time off).

I'd still seek a professional labor lawyer's interpretation, but that was how it was explained to me.

If the employee manual states it can't be carried over, and you don't take it of your own accord, you lose it.

At least that is what the law was 4 years ago when I dealt with it. Any accrued within the policy, must be paid out upon termination.

If they say you'll lose it, then take it. If you argue or try to go against the tide, they will be angry with you and maybe look to fire you in the future. Its their company, their rules. Many places will not cash out your vacation, sucks but you have to deal with it. Try for long weekends and you wont have to take a whole week off and it wont cost them any extra money. If they were interested in letting you cash it out, then they will probably be willing to allow the single days. The owner cant complain if he doesn't have to pay you an extra week.

Exactly. Your company can limit the amount of unused vacation time you may carry by simply "capping", or stopping your accrual of more time until you use some. They are obligated to pay you for your unused time when you leave the company; however, there is no requirement that they allow you to "cash out" unused time while you are still employed.

Just take the freakin' time off and go for a ride.
