Are towing companies liable?

I know it's a revisited topic. Welp, it happened to a buddy of mine last night. Car got towed from my community parking lot and they cracked his oil pan. There wasn't even an argument with the towing company, they called and said his car was leaking oil. They checked and saw a cracked oil pan. They're getting the part today and replacing everything for him free of charge of course, on top of that they said they would cover any scrapes to the bottom (if they exist) since his car is pretty low to the ground. They gave him a loaner car and a big apology. Very nice and good service I'd say on the towing companies part.

Yes they are but good luck proving it. NBC 5 did a story on this a while back. Towing companies would tow people who parked legally and shiet. In Lincoln Park, I have seen cars towed because they parked crooked or a tad too far from the curb.

The companies are liable good one or bad. It's simple to prove...take a picture of where your car was parked. If there's not massive oil spot there then it's safe to assume it wasn't leaking oil when it was parked.

Yeah, but most wouldn't be like well we did this damage and we are going to fix it for free without a fight. I knew a guy that owned a towing company and the shit I saw and heard just made me hate towing companies more then I already did.

Here's my question with the mentality of towing cars parked legit or damaging them and not paying. I understand you might get away with it for a while but then someone is going to take you to court and make it not worth your while. Or someone else is going to bring their gun and really not make it seem worth it. In Chicago, it’s just bound to happen sooner or later, no?

Yes there was. That song was featured on NBC 5 also. I use to go to school in Lincoln Park and saw cars being towed for practically no reason at all. The tow companies saw each car as dollar signs.

It has happened but it is pretty much impossible to prove in court. It is your word against their's.

Sure they're liable, but like it was said, good luck proving it.

You could even take them to court for a wrongful tow, but again, good luck proving it.
