Original Court Thread

The Accident

I went to the follow up court date (3rd one). First one the girl that hit me pleaded not guilty and the 2nd one her lawyer could not make it so it was postponed till today. Now instead of pleading guilty and getting supervision she wants a trial set for Feb 20th. Does anyone have advice on this??

What does your attorney say? Does he think you have a good case? I can give you the name of another attorney if you want a 2nd opinion. He is a friend of my family.

Yeah, just tell the story exactly how it happened. Her attorney will do everything he can to poke holes in your story, even asking all kinds of weird questions. the prosecuting attorney will be on your side to stop him from asking out-of-bounds questions.

Just stick to what happened. You'll win in the end because she was guilty and hit you. Its just annoying that she won't admit it.

When I got hit a year ago the guy who caused the accident plead not-guilty and it went to trial. His lawyer was doing everything he could to trip me up. I just remained calm and stuck to what happened and he was found guilty.

I didn't have to show up today so my Civil lawyer did not come with and I'm awaiting a call back from him, so I am unsure of his opinion yet. This guy is good, never lost a case so I'll stick with him but thanks for the offer JRock I have a great case since it was 100% her fault and there is no way she can back track from this or blame it on me since I had the green light and she was turning left.

You know, I actually was glad my case went to trial. It was pretty cool testifying and seeing the idiot defense attorney ask questions and couldn't trip me up.

Arch has great advice. Keep your answers short and just the facts. Don't interject opinion or speculation. If you don't know the answer to a question then say "I don't know."

You're a smart dude. You are in the right and this will be finally over.

Oh, and even if she wins the criminal case that doesn't mean she'll win the civil case. It helps your civil suit out if she loses the criminal case, though.

This is traffic court so I am not sure if you can refer to it as a criminal trial... The way my lawyer explained it to me is; if she is found guilty than that is not admissible in the civil case but had she pleaded guilty than her plea would be admissible... the only thing that is admissible from the trial is what she says.

Journal all the accident details into a log and keep adding any and all things that you can recall.

probably stuff that your lawyer has already done for you but it never hurts:
- where were you coming from
- where were you going
- road conditions
- weather conditions
- names of witnesses
- notable details (buildings, signs, landscape) around the accident location (shows you were aware of your surroundings and not tunnel visioned)
- what was she wearing/saying when she came out of the car

your brain may be fuzzy from the accident but the more that you can jot down the better prepped you'll be when facing her lawyer

Her lawyer will probably hope to use time to fog your recollection of the events and try to trip you up on minor details. If he gets you backpeddling at all then he might try to get you flustered in other answers.
