EVERETT, Mass. -- A 10-year-old Wellesley boy who tried to play Santa to some homeless children in Everett ran into a legal grinch.

Interview With Peter-Anthony

Peter-Anthony Hereu decided to collect toys and clothing for the children of nine families who lost their homes in a massive gasoline tanker fire earlier this month.

“It means a holiday of giving to other people," said Hereu.

But Everett Mayor John Hanlon said the brand new games, trucks, blocks and crayons were being warehoused because of liability issues stemming from the recent recalls of toys from China.

"We thought there would be lead paint items," said Hanlon.

Hanlon said that city attorneys insisted that the 200 toys the boy collected from classmates and neighbors be rejected. Peter-Anthony's mother, Judy Hereu, called the city's decision to withhold the toys "insane."

"I told them I would sift throught the toys and take out everything with a threat, but it was 'no we can not accept it'," said Judy Hereu.

However, the Salvation Army announced Monday that they would take the toys Hereu collected and go through them. Toys that have been recalled would be removed and the remainder given to the Everett families.

Salvation Army Captain Fred Clarke said his organization was willing to inspect the toys and take on the liability. He called Hereu an "amazing little boy,'' with a "great heart.''

"I feel really good. I hope they can use the toys and have a good Christmas," said Peter-Anthony.

He said he's learned doing nice things doesn't always happen easily.
