Tuesday evening one of the teachers at JJC, who was subbing for my class, was hauled out in hand cuffs by the DEA.

NEW LENOX It may seem the wrong time of year to harvest, but police estimate the crops they took in Tuesday are valued at over $1 million.

Chief Dan Martin said police executed a search warrant and discovered "a large-scale indoor cannabis growing operation," which occupied several rooms in the basement of 18343 S. Gougar Road.

"We seized over 700 cannabis plants and 40 pounds of dried and packaged plant material," Martin said.

Police also seized numerous grow lamps, fans, air-purification units, grow tables and trays and plant fertilizer.

Martin said he was unable to specify what information led to the search warrant of the ranch house, which sits on 2.3 acres and shares a private drive with two other residences near the intersection of Gougar Road and U.S. 6.

"Much of the property is wooded...the home is secluded and difficult to see from the roadway. Unfortunately, the location made it ideal for such an operation," Martin said.

Police said the different rooms in the basement reflected various stages of the marijuana's growing and cultivation process.

Agents from the Drug Enforcement Agency's Chicago office provided police with technical assistance in dismantling and removing the drug operation. Martin said it took around 11 hours to remove the plants and equipment from the residence.

"We filled two 8-foot by 8-foot by 16-foot portable storage units," he said.

Homeowner Phillip E. McClintock, 48, was arrested early Tuesday. Police said McClintock was interviewed for much of Tuesday and Wednesday.

The Will County State's Attorney's office has charged McClintock with felony counts of manufacture or delivery of cannabis, possession of cannabis plants and calculated criminal cannabis conspiracy.
Will County State's Attorney spokesman Charles B. Pelkie said a bond hearing for McClintock is scheduled for 1:30 p.m. today.

Whats funny is his guy was in charge of airflow and hvac design of most of the hospitals in the area. very smart guy, I'm guessing his system at home to grow all of this was astounding.

Typically they catch large indoor growers like this from their thermal emissions. Thermal cameras are used to see if any houses are outputting an abnormal amount of heat from all the lamps used. Then they follow up with checking the electric bill to see if it's abnormally high kilowatt usage. That's typically enough to get them a warrant and check the place out.

Funny thing...some of my fish breeding friends with 50+ tanks in their basements have had their houses searched...when you are running 50+ tanks at 84 degrees, the tricks the cops use to spot indoor farms makes these fish breeders looks like obvious culprits.

That guy that got busted, if he was an HVAC specialist he probably had a fantastic venting system, and that very system is probably what got him caught (if it wasn't a simple tip off).

Next time he should remember to run his exhaust vents undergroud and let the earth cool the hot air before exiting. And that exit port should be a ways away from the house so it's not an obvious exit port.

I've heard about guys with a lot of aquariums getting searched. And ventilation is one of the keys to a good growth, C02 shots will make them hang down like elephant cocks.

The police can't run thermal scans of homes without a warrant. See Kyllo v. U.S., written by none other than that anti-civil libertarian Scalia. Police can't get a warrant without probable cause. So, in short, they aren't just running up and down the block with thermal scopes busting other-wise innocent aquarists.

Something about equipment they use. It has to be available to civilians and such. So, any IR or nightvision stuff is usually not allowed without a warrant?

Sort of correct. The use of "sense-enhancing" technology to gain information about whats going on inside a home is considered a search for 4th amendment purposes and requires a warrant. The part about civilian use wasn't about availability. It was about "general public use." If everyone actually started walking around with thermal imagers, (not just able to buy them if they want), then its a different case. However, that is obviously not something thats going to happen because of other law that prevent people from doing that in the first place. So, for all intents and purposes, thermal imaging is not allowed without a warrant, regardless of the civilian availability of device that is used. The one used in Kyllo was actually pretty crude.

If they were searched without a warrant or with a warrant that was not sufficiently supported by probable cause, they may have a 42 U.S.C. 1983 Civil Rights claim against the Gov't.
