Supreme Court Gun Ban Ruling Expected Tomorrow

The U.S. Supreme Court today did not release its long-awaited ruling on whether the District's handgun ban violates the Second Amendment. That means the potentially landmark decision will almost certainly come tomorrow morning when the court is planning to issue the last of its rulings for the term.

WASHINGTON (AP) - The Supreme Court says Americans have a right to own guns for self-defense and hunting, the justices' first major pronouncement on gun rights in U.S. history.

The court's 5-4 ruling strikes down the District of Columbia's 32-year-old ban on handguns as incompatible with gun rights under the Second Amendment. The decision goes further than even the Bush administration wanted, but probably leaves most firearms laws intact.

The court had not conclusively interpreted the Second Amendment since its ratification in 1791. The amendment reads: "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed."

The basic issue for the justices was whether the amendment protects an individual's right to own guns no matter what, or whether that right is somehow tied to service in a state militia.

Justice Antonin Scalia, writing for four colleagues, said the Constitution does not permit "the absolute prohibition of handguns held and used for self-defense in the home."

In dissent, Justice John Paul Stevens wrote that the majority "would have us believe that over 200 years ago, the Framers made a choice to limit the tools available to elected officials wishing to regulate civilian uses of weapons."

He said such evidence "is nowhere to be found."

We'll have to see what Daley's reaction is. If he is stubborn, we may have to go to court separately to overturn Chicago's ban, but we will have it easier with SCOTUS precedent on our side.

DC yes chicago no, we will have to wait and see what daley says, but I suspect it will go along the lines of it's always been legal here you just need to register them. Of course I dont think the city has issued a registration since the 80's for a regular citizen.

I guarantee he will be in TV today ranting about crazy judges and children being killed in the streets any minute.

Yeah...This does open a can of worms in one way, but it slams the door on the gun grabbers in others! Let's enjoy that for the day and worry about the "Clown Prince" and Governor "Blowdry" tomorrow...today is a happy day!
It does amaze me that the decision was 5 to 4...goes to show how important it is to vote in a Presidential election, even if the candidate that is not your first choice is the nominee! Speaking for myself only here...there are 3 good reasons to vote for John McCain in spite of him not being my first choice ....they are, The Supreme court, the Supreme Court AND...the Supreme Court!!!

I bet you're right. He'll be going on and on about all the murders in Chicago but what he won't mention is that Chicago already has some of the strictest gun laws but also has almost the highest number of gun-related murders.

Hmmmm.... maybe King Daley needs to relook at this gun issue. Obviously all the current laws aren't working.
