People have always been suing other people, it's the concept of "the other guy has big pockets". One example was the case in which Motorola was sued because someone was talking on a Motorola cell phone and caused an accident. Unfortunately, sometimes what keeps this going is the fact that some people figure it is cheaper to settle than fight, and then bad precedent can be set.

And if you really want an outrageous one, remember the guy in Chicago who died from peeing on the third rail while drunk? His family sued the CTA for over a million and won. I don't know if the award ever was reduced or not.

Educate yourself on the details of that case and I think you will have a completely different view of what happened. The woman got 3rd degree burns, along with plenty of other people because MC'ds decided to keep the coffee sitting at a temp that was much higher that was reasonable safe. The woman was award like 1-2 days of coffee revenue from McDonald's because the court wanted to send a message to them, not because they wanted the woman to get rich. There was plenty of history before that but McDonald's kept giving everyone the finger. The court used the tools at their disposal to enact change and get a corporate monolith to change dangerous behavior.

My daughter got 3rd degree burns on her right foot and ankle from hot water from one of those dispensers you find at work. It almost boiled the flesh right off her bone. The boss liked his tea piping hot and the 'kid guards' on the handles were non existent. We didn't sue even though her recover took over a year and screaming agony every day at the urgent care clinic with the burn specialists painstakingly scrubbing the scabs each day (with her screaming bloody murder from the pain) so there would not be any scarring. Today, you can't tell it ever happened except for a very slight pinkish area that is barely noticeable.

Didn't sue the workplace, didn't sue the dispenser manufacturer but did go through all of the paperwork writeup so that the incident could be used as evidence to make it a state law in California to mandate the child-proof handles so that the chances of it happening to someone else would be greatly reduced.

In fact, when it was all said and done it cost us about $10,000 in copays and medical bills.

So, I personally give the lady a big middle finger for continuing to buy the coffee up to that point and PROFITING from the incident.

Everyone Exaggerates

We're being taken for a ride... agaaaaaaain.....

I also heard the worker practically threw the coffee to her causing the coffee to spill and the lid wasn't on all the way. I use to work w/ a guy who was on the case for it.

the lady at mcdonalds should be paid for her medical bills. DATS IT.

If you want to hurt mcdonalds. Have mcdonalds pay a fine. The government gets a 10 million dollar pay check. Now we have to deal with every douchbag that sues because "they" get the money.

The coffee case was her own stupidity and carelessness...

"On February 27, 1992, Stella Liebeck, a 79-year-old woman from Albuquerque, New Mexico, ordered a 49 cup of coffee from the drive-through window of a local McDonald's restaurant. Liebeck was in the passenger's seat of her Ford Probe, and her grandson Chris parked the car so that Liebeck could add cream and sugar to her coffee. She placed the coffee cup between her knees and pulled the far side of the lid toward her to remove it. In the process, she spilled the entire cup of coffee on her lap"

http://en.wikipedia.org/wiki/Stella_Liebeck

This is someone that did something stupid and just wanted someone to blame for it.

This is why insurance is so high and why products cost so much.

More than 30% of the cost of your motorcycle is the built in cost
of future litigation the manufacturer knows will come.

Agreed. Punitive damages should only be awarded if there is a finding of criminal wrongdoing (which would include refusing to correct a problem after they were told to correct it).

Of course, I'd like to hear Rob's take on all this.

You're going to believe wikipedia? Any moron with a computer can add stuff to that site. I've even added stuff to that site.
I don't think that was the same case either, the one I heard was the drive through person "handed" her the coffee and it spilled all over her (the drive through person basically threw her the cup w the cap loose).
This case here is a lot different and she should be smacked.

I would not put it past Mcdonalds to keep editing the wiki page to make sure that it still appears favorable to them. In that particular case the media was down pretty hard on the lady. However there's not way that a 12 person jury would award that kind of money if there had not been some wrongdoing. They also settled out of court, and in secret so you doubly know that they were in the wrong. There are plenty of other frivolousness suits to quote if you need examples.
