Who's a lawyer I need some quick advise

Long story short. I'm trying to settle up with my contractor. The project was done a couple weeks ago. He sent a final bill about a week after. Since some damage to my house was done outside the scope of his contract we deducted the repair bills for it and replied to his e-mail twice left a voice mail and am now sending a fax to him. What's the statue of limitations on this? I know it's over 2 weeks but I just want to get some legal info. I guess he doesn't want his money.

I'm not short. I'm aerodynamically efficient.

I guess if he doesn't want to settle, he's eager for you to open a case file with the BBB. It may not mean much to him now but it might put a dent in future contract jobs if other people research him and find a bunch of complaints about his work and pass over him for some other contractor

did you inform him of the damage after you recived the bill?
did you give him a chance to fix said damage?

It's in your best interest to get him paid even if you need to negotiate the repair costs. He has two years from the date of completion to file a lien on the property if not paid. I would highly recommend you get him to sign a "lien waiver" at the time final payment is made. Chicago Title has a very good standard lien waiver but if you need one let me know.

yes we got a final bill and sent him back a letter explaining the damages and quotes for repair
no he hasn't done much right to begin with why would I want to give him more chances to screw things up.


He did finally respond and said he'd get back to me. For someone that is going to receive money he sure is taking his sweet time. Plus he hasn't removed the port o john from my property. We let him go 2 weeks ago.

We never said we weren't going to pay him. He's just being lazy about the whole damn thing. I mean if you were waiting for a couple k would you take your time to get back to me on any questions I had the the final bill? I know I wouldn't. With that being said we've documented every meeting we have had with him I've kept all e-mails to him and we've taken pictures of any extra damages.

BTW He wasn't the cheapest. We looked at 5 different contractors and he fell in the middle and we liked him. I'm a bad judge of character I guess.

if you do write him a check. On the check make sure you write that you protest in paying him because of ........... That way, if you take him to small claims. You show the judge you didn't want to pay because he fawked things up. Then you get the paper work of what it cost for the repairs by another contractor.


if that pody thing is on your property. Might help calling the village building inspector and see if they want to help you out. Tell them to start giving the contractor a fine for leaving his stuff on your property.
