This is a couple weeks old but I haven't seen it here yet. The second link has the surveillance video. I think he is going to be convicted.

That's a tough one. The moment someone walks into a store and pulls a gun I believe they should immediately forfeit their rights. The shop owner should have a right to fire even before being fired upon.

Whether or not the downed attacker was conscious or not I'm not sure the owner needed to shoot him 5 more times, seems excessive. But he probably wanted to make sure that person could no longer pose any harm to him or his family in the store. He seemed pretty calm about it all. I wonder if the first (head) shot was fatal.

This is where it will all revolve around, IMO... because at that point there was no longer a threat for one's life or property.

Up until that point, I think the guy was entirely within his rights (except for maybe the foot chase)... but upon returning, that's where it went wrong, legally.

I don't agree with the additional shots, but the one to the peanut was justified.

I don't know, though, you do hear horror stories of criminals breaking into houses, being maimed by the homeowner AND THEN SUING THE HOMEOWNER!!!

I don't know. I hope he does go free, as I'm sure his adrenaline was pumping. The jury has to really think when their deliberating - Is this guy a danger to ordinary people (no, I'm sure he's never unloaded a clip in someone who wasn't robbing him) or just a threat to criminal? I think the latter.

They're lucky I'm not on the jury. He'd be walking for sure.

How about the anonymous bailout? Tell you that there's some rich people out there that actually care about our second amendment rights.

This is a very tough one. I applaud him for taking the steps to defend himself and co-workers. The minute the two robbers stepped in there with a gun, they lost all they're rights. He was exercising his rights that we still have for now. Sans Obama. Anyway, I think the extra shots might have been a little much even if the robber was moving. If you read the text, he said that the robber was trying to get up. No film proof due to angle. If the robber took one to the head, I don't think he was going to move let alone get up. It was self defense with the head shot. The argument is going to be, was the robber still moving or trying to get up. Only the pharmacist and robber know that one, sans film footage. How are they going to prove that the robber was still breathing when the extra shots were put in him?? Murder charge is going to be tough, unless different facts come out in the testimony. Alot of emotions and adreneline were running through him and he acted accordingly. I know that if it was me, I would have fired more only if the robber was still a threat. I'd like to see the outcome of this one. He has alot of support from the masses on this one. May be in his favor.

My feelings are if he thought the kid was still a threat then why did he run past him out of the store and then come back in the store and walk past him with his back turned to him. IMO that shows that the kid was not a threat anymore and that is why he was charged.

First shot to head OK, after that not acceptable IMO. Like someone said, he walked past the kid with his back to him, reloaded, then came back and shot him 5 more times. There was no more threat after the first head shot. If the kid was getting up, he should have kicked him in the head or something, not shoot him again. I don't think this kid even had a weapon on him. The other guy had the gun.

I actually thought the kid was retarded and just stumbled into the hold up. Why didnt he just shoot him once in the shoulder? Kick the gun away? I understand adrenaline running, but reloading after turning your back on him?

He was just making sure he's dead, so that in our fucked up judicial system the kid didn't sue him if he survived. As many said before, if you're gonna shoot, make sure you shoot to kill.

Thing that's gonna fuck him is the fact that he ran out, came back and than shot him... but I still hope he walks.

jst watched the video,

He was calm cool and collected. took his extra shots then made the phone call to the police while the ladies were in the back safe and sound.

Make sure the guy isnt goingto get up and shoot HIM in the back of the head while he calls the cops.

I think he made the right choice and not trust that the kid was playing "possum"

I love hearing how the extra shots were "EXCESSIVE" as if it's possible to overly kill someone. People watch too many movies and think the guy should have just wounded him and made him drop his gun and made a citizens arrest. Reality is, you have no idea how you will react to an armed assailant. anyone who has had military or police training knows that there is no shoot to wound only shoot to kill. The offender was a threat, plain and simple, put him down and make sure he stays down. Good for you Mr. Ersland. I would rather be judged by 12 then carried by 6.

Exactly, but you forgot he reloaded also.

If he thought the kid was a threat, then he should have shot him again on the way out of the store to chase the other guy. Then I'd say OK, adrenaline. But he had too much time to think about what he was doing. If the kid died from the orginal shot to the head, then I'd be OK with it and say it was self defense. Also, if there wasn't a camera he would have got away with it.

I think the little fucker got what he deserved and when I hear the mother saying "you killed ma baby!!!" I think she should shut the fuck up. Even if it's your kid, he's a fucking monster and is a danger to others and has probably taken other people's lives so shut up whore. Okay now that the anger is out.....I also think that the shooter is a complete dumbass. He just sealed his own fate by shooting a near dead kid on camera.

If I was on the jury that man is walking. I have been told law enforcment are trained shoot to kill. If the head who wash the kkill shot maybe he did fear for his life. Victims are often afraid even when they KNOW their perp is dead or behind bars. He is not trained for this high stress circumstance and might think rational. As for this womans baby...... Rest in hell! U do the crime deal with the outcome.
