I got a ticket for not having an M class on my d/l. My court date was this past monday. I showed up and when my name was called I went up in front of the judge. The judge asked if I want to pledge guilty or not guilty to my offense. I plead not guilty. The judge then told me to have a seat. Afew minutes later this old lady walks up to me and she says that she's the prosecutor and if I wanted to talk about my case. I'm like 'yes of course I do'.
Before I could say anything she said that if I plead guilty the fine would be $100 and or if I took it to trial that it was very possible to recieve jail time. I'm thinking to myself $100 or jail time WTF. So, I then explained that I did not have my permit on me at the time and that the cop said if i showed up with my permit the ticket would be dropped. The prosecutor than said that even with my permit I did not have someone riding with me with a valid class m d/l. I then told her that I now have my class M 'which she payed no attention to'. I then said that I felt a $100 fine was alittle much to pay for the offense. She then got loud and said that I could get jail time for this. Now I'm thinking that I should call her a bitch and see if she would violate my wright to freedom of speach, but I didn't want to deal with it anymore i told her that I would plead guilty and pay the fine.

I don't know how they do things in the burbs, but in chicago the judge would have thrown out the case. This very same thing happened to a friend of mine and the judge through it out when my friend show up with a class m d/l.

Sounds like you suffered from Prosecutorial intimidation. She was pushing you hard. can you imaging being in the jiont answering the what are you in for question with that. I dont think any judge in his right mind would give you jail time for that.

I would have called her bluff. There is no way you can go to jail for a first offense of failure to produce a valid drivers license. I suppose if the judge wanted to be a prick he can slap you with a fine and community service or something but no jail time.

Say you get pinched for no proof of insurance. If you can get proof by the date of your court appearance then they drop the charge. I have been witness to this firsthand on several occasions. I would assume the same for a valid license, ESPECIALLY since you do have a valid one now and had a permit at the time.

or you can always say you were riding with your friend, he took off and you were trying to catch up to him when the cop stopped you.... worked for someone I know

On one hand, yes she was a bitch, and I doubt you'd get jail time.

But on the other, how can you get pissed off about getting busted? I mean, you DID NOT have your license!

I believe its if you prove you had insurance "at the time you got pulled over" . Like if you just didnt have your ins. card on you or in your car. They dont just give you between the time you got pulled over till your court date to go get insurance.

I suffered from prosecutor intimidation as well when I first got my drivers license... it was with my car, and I got a bogus ticket... but that time I only had to pay 50 bucks and court supervision. Court in the Burbs sucks plain and simple. Jail time for that would have been BS... and also how could they prove that you were not riding with someone... was that in the ticket?

Yea I woulda brought a buddy and just said that he was riding in front and didn't see you get pulled over.

Now one thing about this threat of jail time. I'd wipe my ass with those words and hand it right back to her. See jail usually works out best for the state if you're some bum who doesn't contribute anything to society and by putting you in jail it's still the same thing. But take a student, professional, or normal worker of some sort and it's a different story. I think it would take more to go to jail than if you were just sitting on welfare for example. Though it shouldn't be that way, just seems like it. Pulling you out of school or a job for some dumbass offense makes no sense in the state's eyes. Here you are working...paying taxes on the money you make and contributing to society. Now we'll shove you in a cell for some small moving violation? That makes no sense. Each time I've been in front of the judge (cough) I've been asked what I do. The last time was on handgun charges (bs) and I responded "Graduating from DePaul in two weeks then working." The judge looked around and didn't spot the officers so moved to drop the charges with the prosecutor and they agreed. In 1 minute my case was tossed out. Chicago PD inherited my handgun (cease and destroy my ass), and $10 out of my bond. It was a win win as I look at it.

I know I was guilty, but $100 fine. Like I said before 'in chicago the case would have been thrown out if I showed up with the class m. I think the burbs get some of their revenue for the year from traffic offensives. I wonder what the percentage is on that.

I didn't think to bring a friend alone to say that he was riding with me at the time. Maybe next time around 'oh, there will not be a next time'.

head toward the 3rd star on the right in orions belt and hook a lewy when you pass the big red eye, make sure you slow down for the turn cuz you dont wanna miss it, theres no turn around for a few miles.

Du Page Co. conviction rate is so high because of this type of intimidation. If a person pleads guilty to a charge, Pleads guilty to a lesser charge in fear of jail time, or any type of plea bargain its still a conviction. I say screw em'. Always plead not guilty and make them earn their salary just like all the rest of of working stiffs. My .02

No you wouldn't have gotten jail time. But you were driving without a license at the time you were pulled over. I don't see why you plead not guilty when you know what your doing was illegal ....your buddy was lucky if he got it dropped. Personally I would have felt lucky to pay $100 and get out of there. Pleading guilty and taking it to trial will most likely cost you much more at the very least in lawyer fees.

Guess what! You're license will be suspended as well. Two months suspension is automatic and mandatory, completely separate from the court appearance. Bet ya didn't know that. You should get a notice in the mail in a couple of days. They will ask you to send in your license to the state or a warrant will be issued for your arrest. Your license will be sent back to you via post mail on the date your suspension ends.

When I plead guilty the judge also give me supervision. When I asked the judge how long the supervision was going to be for, the judge said that if I paid the fine today the supervision would be over with today. Now, what kind of crap is that. I know I'm getting off easy with this sentence, but I only go into Downers Grove for work.

I have rode with a couple of people who had permits and the cops let them go. I guess it depends what mood the swine is in that day. There are swines that ride and swines that hate motorcycles. It's just the chance you take.

I just finished gasing up the bike for my ride back home from work. I was making a left turn onto Finley. I wasn't speeding or anything like that, the cop just decidced to run my plates.
