Gotta present in the mail....fukn court papers from the ex demanding more child support. Had a feeling this was gonna happen...house purchase is a matter a public record...she needs a life!! Get this shit!!
1. She's trying to have me held in contempt of court for "failure to disclose change of employer and change of of income" I have ILCS 750 5/505 memorized. I have to notify a change of employer within 10 days, thats fukn hilarious. Been self employed for almost 2 years, 1099's and everything. Plus its only a big deal if I skip out on payments. I have no order of withholding. I mail check directly to the state. How's that for responsibility!! But there are no provisions for a change of income. Child support orders are not up for automatic periodic review.
2. She is also trying to have me held in contempt for failure to provide my "dog grooming price list" as if thats a clear indication of my income.
3. More contempt charges..failure to provide plaintiff or court with government documents (tax records) regarding my income....Some divorce decrees and child support orders have provisions for these to be turned over each year by a certain date....not in any of my papers. I was never ordered to supply these. She has to file a motion for discovery for these.
4. Even more contempt....wants to be granted back support because it "appears" that my income went up sometime between the order entered July 18, 2007. and now. She says my support was decreased through false pretenses...at the time of the order my earnings were $XXX. My lawyer showed the judge the documentation and the judge found nothing fishy and slammed the gavel. At the time it was legit I was just starting this career and I wasn't making alot. My ex agreed to the order in front of the judge!! WTF!?! THere is no back support, there is no arrearage...alll seh can do is get more money from the "AGREED" order forward. Besides I'm current, actually I'm ahead on payments. I make more money "NOW" so she is entitled to more...oh well
5. Now for the bullshit!!! she wants the judge to grant her the tax exemption for the years I took it as part of our divorce decree. She wants the judge the give her my tax refunds for the last 2 years...even though I'm current on all support!!!
6. She also wants all bank records with my name on them...hope she's gotta good forensic accountant...My name is on my personal account, my fiance's account, both of my parents accounts, both of my parents business accounts. God luck with that one
Oh, and she is doing all this without a lawyer...The grammar and spelling on her petitions are 5th grade at best. They are unorganized and the law(s) she sites are innaccurate. She doesn't know court procedure and I think I can get this thrown out or simply beat it at a hearing.
7. SHe also alleges that I get paid in cash under the table...even if that were true I could never admit that in open court, That's basic 5th amendment right there!!!
I'll get my tax records for the last 3 years. My bank statements for the last
90 days ( all of which are water tight ) As far as her making the claim against my new house purchase...my RN girlfriend makes terrific money along with a steady stream of child support. I took the mortgage out in my name and through some creative paperwork the mortgage broker inflated my income for the purpose of the loan...My fiances credit is not the best but our combined income qualified the loan.
i figure to offer my ex $75, $150 total more a week to leave me alone...if she balks at it...I'll be happy to spend $10K on a lawyer to make her life hard...I've done this before!!!!
