How do I patent an idea and bring it to market.

Ok I got a killer idea for a product. Do any of you guys know what i need to do to obtain a patent so no one can steal my idea?

Do I need a lawyer or something for this? I want to make sure NO ONE can steal this concept. I wanna somehow bring this to market, I'm thinking I'll have to sell it to another company since I dont have a manufacturing facility. But if I could get cash and poyalties it would be cool as hell.

I saw you giving this a shot on SBN:D . Best I can tell you is call a lawyer you trust.
Get a lawer....AND GET A DAMM good one if your going to sell the idea to a manufacture ..if not...royalties and stock option, unit gross sells, you'll get fucked out of.

Going to the library and doing your own patent search might be a good start. You wouldn't believe the things that are patented, so there are odds that someone already has it patented.

Do a search on the net or get a book to get an idea of what it entails.

When we were looking at patenting some of our software I think the cost was around 10 - 20 grand. And there's a lot of work involved. Details and details to cover and submit, and then if they don't like it, revisions...

Talk to a patent lawyer.
First thing, draw up some preliminary plans, have the plans copyrighted, sign at least one copy of the plans along with a Notary to verify the signature and DATE. Seal the plans in an envelope and send a copy to yourself via registered mail. DO NOT open the received one and keep in a safe place.

Next, if your serious about this, you'll need a patent attorney to perform a patent search to make sure a similar device is not already patented. This could easily cost you upward of $20K.

In most cases, you need detailed plans and a working model. Although over the years I have heard of patenting intellectual property like certain computer algorithms. These are not supposed to hold up in court, because you cannot patent IDEAS you patent DEVICES.

BE CAREFUL who you talk to about this! Ideas are stolen all the time.

If there is a similar device already patented you may still be eligible if you can show innovation of design, features, etc. which make your device unique.

Pick up a book on the patent process and consult a patent attorney.

Yup my idea, takes something that is kind of already out there and modifies it work in a different situation where it is definatly needed and not there yet.

i still got that penis pump and its still fucking working till this day.

btw since you forgot it was that vacuum penis pump but yours was like a wet/dry vac. as you can dump multiple loads in it before the need to clean:bow:bow
Used to work in r&d, then started my own company in which we received patents, did product testing, dealt with sources overseas that I have been using for over 6 years to produce product for me. If u have any questions shoot me a pm with your number and I will give you a call.
Patents are only usefull if you have enough money to pay lawyers to defend it. If this is a simple item that you can mass produce and flood the market with before people knock it off 6 months to a year later, then I would go that route. Make your money really quick and then stop production, take your money and run.
Poor mans patents cost almostnothing and are just as good as long as you researched prior patents first.

Tony, if you are serious, drive up here for some beer and a chit chat. I have been through the patent process many times, even hosted seminars on it.

There are some simple things that you can do to check the originality (prior art) and some things that you can do to minimize overall expense. FWIW, patents were originally intended for devices, but have been extended to include a wide variety of issues related to intellectual property, and business processes.

My guess is that what you are thinking of is a device, and as such, is far easier to protect. If indeed it is a modification of an existing prior art, then it can be structured as a derivative from that prior art, and is protectable on its own.

The initial patent process gives you one year to provide the final information and complete the protection process. Patents are also issues on a country by country basis FYI.

There are also Copyright, registered, TM, and SM types of protection, not withstanding the Trade Secret solution.

Again, tons of experience with this, and can tell you what may be best for your situation. Should you wanna proceed, I also have experience with a few patent attorneys for various types of applications that you can work with.

I can produce this relatively easily at home but I think it would sell quite well and its in a market I already have an interest in and havent seen anything like this

Your idea was a wooden chock T. With scrap 2x4s and nails from the new construction next door, you modify a trailer bought on the cheap and then flip it in 10 days at twice the price. I remember the blueprint vividly.
